New POA law effective Sept. 1

Beginning Tuesday, powers of attorney in New York must be accompanied by a statutory rider to authorize an agent to make major gifts and asset transfers.

The new power of attorney law, Chapter 644 of the Laws of 2008, was signed in January. It is designed to enable more careful consideration of the broad powers a POA grants to the agent. The measure revises Title 15 of Article 5 of New York’s General Obligations Law. (NY G.O.L. [section]5-1501.)

The new law contains other changes relating to both the content and the execution of the power of attorney form, including an acceptance by the agent. (NY G.O.L. [section]5-1501B subd. 1(c)). In addition, the form is now durable, and not affected by later incapacity, unless the form specifically provides that it is terminated by incapacity of the principal. (NY G.O.L. [section] 5- 1501A). If a guardian is later appointed, the agent will account to the guardian rather than the principal.

The statutory short form POA is set out at NY G.O.L. [section]5- 1513

New puzzles, brainteasers keep a category relevant and reliable

Out of all the tried-and-true, time-tested toy categories, puzzles and brainteasers may well have one of the largest fan clubs. There’s something for everyone when it comes to puzzles, typically at a very affordable price points, which is more important than ever in today’s current economic climate. Fortunately, as toy retailers are struggling to attract customers, established puzzle companies (and a few upstarts) are responding with a slate of new products that are keeping veteran puzzlers happy–and drawing in new ones every day

Family law sources on the Web

LawNow, May-June, 2008 by Shaunna Mireau

My husband and I recently celebrated 15 years of wedded bliss. According to Statistics Canada’s “The Daily” for Wednesday, March 25, 2005, our chances of staying married are pretty good: “The grand rapids family law peak divorce rate in 2003 occurred after three years of marriage, when 26.2 out of 1,000 marriages ended in divorce. The risk of divorce decreased slowly for each additional year of marriage.”

The statistics on the site above also suggest that about 40% of Albertans will divorce before their 30th wedding anniversary. When I see numbers like these, I am thankful that my husband, my children, and I have never had to make use of the tools that are provided online to help families deal with issues like divorce.

For families in crisis looking for information, the Internet is an excellent source of legal forms, starting points, professional referral services, and toolkits

Petit Bateau Receives Corporate Leadership Award at Room to Grow 10th Anniversary Gala

Business Wire, Dec 10, 2008

French company honored for innovative charitable donation partnership

NEW YORK — Petit Bateau, the global iconic clothing brand from France, received the Corporate Leadership award at Room to Grow’s 10th anniversary gala auction chaired by Uma Thurman at Christie’s auction house in New York on December 2nd.

Petit Bateau was recognized for its collaboration with Room to Grow, a non-profit organization dedicated to enriching the lives of babies born into poverty during their critical first three years, as an exclusive retailer accepting in-store donations for free distribution by Room to Grow in New York and Boston. Since its partnership began in January this year, the French company has also donated $50,000 of new merchandise to Room to Grow and encouraged volunteer activities by Petit Bateau employees.

“Our partnership with Room to Grow makes perfect sense because we are both dedicated to investing in our future – the future of children and the well-being of their parents,” said Philippe Berlan, Director General of Petit Bateau, who accepted the award at the event. “Room to Grow’s work offers greater hope and more comfortable lives for future generations. Petit Bateau was founded on values of quality and comfort that have been transmitted from generation to generation. We are proud that our employees initiated the idea to support Room to Grow, and we all look forward to enriching future generations together.”

Under the unique partnership, Petit Bateau boutiques in Manhattan, Hackensack, Greenwich and Boston have become local donation centers for Room to Grow. New and gently used baby items are accepted at the stores, helping the organization accelerate and simplify collection and distribution to families.

“This innovative alliance sets a new model for Room to Grow and has allowed us to increase our donations considerably,” said Lexy Mayers, Executive Director of Room to Grow in New York, who presented the award to Berlan. “We were delighted that Petit Bateau took the initiative to offer us such a creative idea for collaboration.”

The sold-out event, hosted by Christie’s auction house in Rockefeller Center, also honored Julie Burns, Room to Grow’s founder, for her dedication to a cause she identified and acted upon over ten years ago in a Harlem storefront.

About Room to Grow

Founded in October 1998, Room to Grow is a non-profit organization dedicated to enriching the lives of babies born into poverty throughout their critical first three years of development. Parents expecting a baby are referred to Room to Grow by a selected group of prenatal programs serving low-income parents throughout the five boroughs of New York City and Boston. Upon their referral, parents visit Room to Grow every three months from just before the birth of the baby until the child turns three. During their one-on-one appointments with a clinician, parents select new and nearly new clothing, toys, books, and other baby essentials, free of charge, and receive information and support to ensure their child’s healthy and secure start in life.

Farmers Insurance Donates to China Earthquake Relief Effort

Business Wire, June 18, 2008

LOS ANGELES — The Farmers Insurance Group of Companies is aiding in the relief effort for the hundreds of thousands of people affected by the China earthquake.

Shortly after disaster struck China’s southwestern Sichuan province on May 12, Farmers offered to match donations made by Farmers employees, agents and district managers, their friends and families up to $100,000 to help those affected by the 7.9-magnitude earthquake.

After Farmers agent Lisa “Lan” Ngo heard about the generous offer, she quickly shared it with her colleagues at Sacramento Chinese of Indochina Friendship Association (SCIFA) and she and nearly 1,000 of her friends and neighbors raised $135,000 in a single evening. Other members of the Farmers organization have also donated, and together a check for $240,741 will be presented for China earthquake relief.

“Although this tragedy happened on the other side of the world, many people within the Farmers organization have family and friends who have been affected by the earthquake,” said Paul N. Hopkins, Chief Executive Officer of Farmers Insurance Group. “This is our way of extending our hearts to a nation who needs our help.”

Farmers Insurance has selected two charities to receive donations: the Mercy Corps and the Red Cross Society of China. The Mercy Corps works amid disasters, conflicts, chronic poverty and instability to unleash the potential of people who can win against nearly impossible odds. The Mercy Corps has already airlifted over 32 tons of needed food and supplies to the affected area and has now focused its efforts on the psychological needs of traumatized survivors.

The Red Cross Society of China is providing emergency food, shelter and aid as well as emergency personnel. In addition, it has already begun post-disaster construction coordination to ensure safe water supplies and hospital facilities.

The official death toll from the quake climbed to 69,159 on June 11, with another 365,399 people injured and 19,350 still missing. About 5 million are thought to be homeless.

Farmers Insurance Group Federal Credit Union is accepting donations in a special China Earthquake Disaster Fund. Credit union members can transfer money right on their Web site, and non-members can mail or drop off donations to any local branch. To learn more, go to: www.figfcu.com.
